The court of first instance decided that the death of 3-year-old Hania was not a homicide. The girl’s mother, sentenced to 3.5 years in prison, has been released. During the appeal, she will answer on a free foot. The case is shocking, because the collected evidence shows that Hania was beaten and oppressed for many months. On February 19, 2021, she died. Łukasz B., Hania’s mother’s cohabitant, kicked a small child in the stomach. Broken track. Lucyna K. and her cohabitant, Łukasz B., were accused by the prosecutor’s office of acting jointly and in concert, they abused 3-year-old Hania with particular cruelty, and on February 19 they killed her.
However, the District Court in Świdnica decided that the death of 3-year-old Hania was not a homicide, but causing injuries resulting in death. Łukasz B. was sentenced to 17 years in prison, and Lucyna K. to 3.5 years in prison. The judgment is not final.
For me it is incomprehensible that the court released this degenerate mother. I hope that this … will not come back to live here – says one of the residents of the tenement house where the crime took place.
During the appeal, Lucyna K. will answer to the court free of charge. If the higher court upholds the sentence, Lucyna K.’s defender will be able to apply for conditional remission of the rest of the sentence. Then the degenerate mother will not return to the prison where she was for a year and 9 months.
Mute and deaf
Hania was beaten for many months. Why did the court and social officials ignore it? The girl’s family had judicial and social supervision. The probation officer and the family assistant regularly visited the apartment at ul. Political Prisoners. How did they not notice any alarming signals?
It turns out that there were signals indicating inappropriate parenting methods. And there were so many of them that the probation officer, during one of her visits, asked her parents to undress the girl so that she could see her. The probation officer then saw a slap mark on her buttock. This, however, in the court’s opinion, was not a reason to establish foster care. In the docs, it’s just a slap. It is a pity, because the prosecutor’s office confirmed the murder as long-term abuse of the child and finally severe beating, which resulted in death.
Officials became interested in Hania and her family when the girl was a dozen months old. All because the child had blue eyes. In addition, the family’s curator was to receive information about “improper upbringing methods”, including isolation and frequent spanking.
-There was also a report to the police from one of the neighbors who could not indifferently listen to the crying of a small child. The police came and said that everything was ok. They also believed the mother’s assurances that it was just intestinal colic and blamed the neighbor for calling the officers for no reason.
Crying was heard often. But after that incident with the police, no one ever reported it again –
one of the neighbors said after the tragedy.
Death Kick
The tragedy that all of Poland was talking about took place on February 19, 2021 in one of the apartments in a large tenement house at ul. Political Prisoners in Kłodzko. The girl’s mother testified that she noticed her daughter wet herself in the cot. A 30-year-old woman decided to punish her. She dragged the sobbing baby into the bathroom and put it under a stream of cold water for a few minutes.
After a cold shower, the child began to vomit and lose consciousness. An ambulance was called, but it was too late. Hania died. The story soon turned out to be even darker. An autopsy showed that it was not the body’s exodus, but the beating that was the cause of death. Łukasz B. admitted to kicking Hania, which led to spleen rupture and death.
Curator in Ząbkowice
The prosecutor’s office also accused the probation officer who supervised Lucyna K.’s family. She accuses the court staff of failing to fulfill their professional duties, consisting in the lack of proper control of Lucyna K.’s family environment required by law, lack of cooperation with relevant institutions, such as the school and kindergarten attended by Lucyna K. children of Lucyna K., lack of verification of the information obtained about the use of violence against the minor Hania, as well as giving untruths in the supervision documentation.
The suspect pleaded not guilty to the alleged offence. She claims that she exercised probation supervision in a proper and reliable manner. Her case is examined by the District Court in Ząbkowice Śląski. She faces up to 5 years in prison.
The trial started with a delay due to the defendant’s health problems and the need to transfer it from the court in Kłodzko to the court in Ząbkowice. The first session of the court took place during which the trial was closed to the public
