Introduced in 2017, the De-Bekisation Act collectively reduced pension benefits former functionaries of the security authorities of the People’s Republic of Poland. Nearly 40,000 people have been affected by the decision. people, including 8,000 widows and children receiving family pensions. Pursuant to the Act, the amount of their benefits may not exceed the average old-age pension in the country.

The new regulations included the last two living heroes of Operation Samum, i.e. Col. Andrzej Maronde and General Gromosław Czempiński.

“The Court of Appeal in Warsaw, having considered on November 23, 2022, at the hearing of the case of Colonel Andrzej Maronde against the Director of the Pension Institution of the Ministry of Interior and Administration in Warsaw – regarding the amount of the police pension, issued decisions favorable to the appellant” – reads the statement of the law firm Sowisło Topolewski, which handled the case of Col. Maronde.

“First of all, the Court of Appeal restored the deadline for lodging a complaint against the decision of the District Court in Warsaw on the discontinuation of the proceedings, which was issued in 2019 as a result of the appeal being withdrawn by the appellant himself,” we read further.

“Secondly, the Court of Appeal, examining the merits of the complaint of Colonel Andrzej Maronde’s attorneys against the decision to discontinue the proceedings, fully sharing the arguments of the appealing party, came to the conclusion that discontinuation of the proceedings in the realities of the case was unacceptable, because it violated the legitimate interest of the insured and was contrary to the principles of social coexistence In view of the above, the Court of Appeal overturned the decision of the District Court. The case concerned an appeal against the decision to reduce the amount of the old-age pension on the basis of the provisions of the so-called de-ubekization act “- the law firm continues.

In 1990, Polish intelligence undertook a dangerous operation to transport CIA and American DIA officers from Iraq. These were the first months of cooperation between Polish services and NATO countries. The intelligence services of other Allied countries did not want to undertake the operation. Poles applied because they had good contacts in Arab countries.

The success of the operation brought recognition to the Polish services from the US. Gen. Czempinski was decorated by President George Bush, the US government helped in the construction of the GROM unit. The operation also helped negotiate Poland’s accession to NATO.

In November 2021, the court restored the pension of another of the heroes of Operation Samum, Gen. Czempinski. The District Court agreed with the arguments presented by his lawyers and stated that the general’s service in the Department I of the Ministry of the Interior (civil intelligence of the People’s Republic of Poland) was not “service for a totalitarian state”.

In June 2021, the Constitutional Court ruledthat lowering the disability benefits of former SB officers is in line with the constitution.
