The government proposed to set a fixed amount of the fine for failure to register the vehicle and to notify the disposal of the vehicle. Three amounts of fines are specified. A self-amendment on this matter is already in the Sejm. The changes are to enter into force on January 1, 2024.

The Sejm has received a self-amendment to the government’s bill amending certain acts in order to limit certain effects of identity theft. It provides for – as indicated in the justification – “improvement of regulations imposing financial penalties on vehicle owners for failure to notify the sale or purchase of a vehicle within the deadline”.

“Legal solutions introduced on January 1, 2020, imposing the above-mentioned penalties on vehicle owners, over the next few years of their application, turned out to be ineffective and cause significant inconvenience to citizens and local governments. The proposed amendment organizes the current legal status and aims to limit the obligations after citizens, and to simplify and shorten administrative procedures.

Vehicle registration

One of the articles included in the self-amendment states that the owner of the vehicle is obliged to submit an application for its registration within 30 days from the date of: purchase of the vehicle in the territory of the country; bringing the vehicle to the territory of the Republic of Poland from the territory of a Member State of the European Union or admitting it for trading by the authority of the National Revenue Administration. In the case of entrepreneurs operating in the field of vehicle trading, this period is 90 days.

In addition, the owner of a vehicle registered in our country is obliged to notify the staroste within 30 days of the sale of the vehicle and a change in the facts requiring a change in the data entered in the registration document.

Failure to comply with the above obligations may result in a financial penalty. Currently, the amount of the fine must be between PLN 200 and PLN 1,000, “which means that the citizen is not sure what penalty the starost will impose on him.”

Vehicle registration after the deadline – penalties

The self-amendment stipulates fixed amounts of the fine for failure to comply with the obligation to register the vehicle and notify the sale of the vehicle. According to the government, this is to ensure equal treatment of vehicle owners and simplify proceedings.

The amendment introduces fines in the amount of:

  • PLN 500 for the vehicle owner who has not submitted an application for vehicle registration within 30 days,
  • PLN 250 for the owner of a registered vehicle who did not notify the staroste of the sale of the vehicle,
  • PLN 1,000 for entrepreneurs conducting business activity in the field of vehicle trading.

The changes are to enter into force on January 1, 2024. The government draft is being processed in the Sejm.
